We operate this store and website — including all related information, content, features, tools, products, and services — to provide you with a thoughtfully curated shopping experience (the "Services"). Old Soul Threads is powered by Shopify, which enables us to bring these Services to you.

The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when using our Services.

You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

All Old Soul Threads pieces are handcrafted and one-of-a-kind, made from repurposed, pre-loved fabrics and garments. We have made every effort to accurately represent our products through photography and descriptions. However, please note that colors and appearance may vary from what you see on screen due to your device type, settings, and display configuration.

Because each piece is uniquely upcycled, no two items are exactly alike. Minor variations in fabric, texture, color, and finish are inherent to the nature of our work and are not considered defects. Small imperfections are part of what gives each Old Soul Threads piece its character and soul.

We do not warrant that the appearance or quality of any product purchased will meet your expectations or be identical to how it appears in our store imagery.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Old Soul Threads reserves the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before that confirmation is issued.

Because our pieces are one-of-a-kind and handcrafted, please review your order carefully before submitting. Due to the unique nature of our inventory, Old Soul Threads may be unable to accommodate cancellation requests once an order has been accepted.

In the event that we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at the time of purchase.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices in our online store may differ from those offered in physical stores or through third-party retailers. From time to time, we may offer promotions that affect pricing; such promotions are governed by their own terms and conditions. In the event of a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all transactions. You agree to promptly update your account information — including your email address, credit card number, and expiration date — so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method provided; (iii) charges incurred will be honored by your financial institution; and (iv) you will pay all charges at posted prices, including applicable shipping, handling, and taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. All delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, or other events outside our control.

Once your order has been transferred to the carrier, title and risk of loss pass to you. Please refer to our Shipping Policy for full details on processing times, carriers, and tracking.

SECTION 6 - INTELLECTUAL PROPERTY

All content and materials available through our Services — including but not limited to trademarks, brands, text, displays, images, graphics, product photography, video, and audio, and the design, selection, and arrangement thereof — are owned by Old Soul Threads, its affiliates, or licensors and are protected by U.S. and international patent, copyright, and intellectual property laws.

Old Soul Threads is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made in our store are made directly with Old Soul Threads.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions between you and Old Soul Threads, including any injury, damage, or loss resulting from purchased products or services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Old Soul Threads.

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT SHALL OLD SOUL THREADS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM: (I) YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES; (II) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (III) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE SERVICES OR ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Old Soul Threads, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of or related to: (1) your breach of these Terms of Service or any documents incorporated by reference; (2) your violation of any law or the rights of any third party; or (3) your access to or use of the Services.

We will notify you of any claim subject to indemnification, provided that failure to provide prompt notice will not relieve you of your obligations unless you are materially prejudiced by the delay. We may control the defense and settlement of any such claim at your expense, including the selection of counsel, but will not settle any claim that imposes non-monetary obligations on you without your prior consent, which shall not be unreasonably withheld. These Terms of Service, and any separate agreements whereby we provide you Services, shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. You and Old Soul Threads consent to the exclusive venue and personal jurisdiction of the federal and state courts located in Tennessee.
